Lawful vs. unlawful orders
Lawful orders: Must be related to military duty and have a valid military purpose. They must be clear, specific, and not conflict with constitutional or statutory rights.
Unlawful orders: Are those that are clearly illegal, such as orders that require committing war crimes like targeting non-combatants. Service members have a legal and ethical duty to disobey these.
The duty to disobey
While service members have a duty to obey lawful orders, they also have a duty to disobey unlawful ones.
If an order is perceived as unlawful, a service member should follow the proper procedures for addressing the order.
The key principle is that the duty to follow an order only extends to lawful orders.
Ordering the death and destruction of non-combatants is an example of an illegal order. To Date neither Trump nor Hegseth have provided A SINGLE SHRED OF EVIDENCE THAT THE SHIPS DESTROYED WERE LEGAL TARGETS.
